1. Introduction & Agreement

Welcome to Coocoo! These Terms of Service ("Terms") govern your use of the Coocoo mobile application and related services (collectively, the "Service") operated by Coocoo ("we," "us," or "our").

By downloading, installing, or using Coocoo, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service. These Terms apply to all users, including family members invited to view shared content.

2. Eligibility & Account Registration

Age Requirements

  • You must be at least 18 years old to create an account and manage family circles.
  • Users between 13-17 may use the app with parental consent and supervision.
  • The Service is designed for sharing photos of children; however, account holders must be adults.

Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and complete registration information.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.

3. Service Description

Coocoo provides a private, invite-only platform for families to:

  • Share photos and videos of babies, children, and pets within private family circles
  • Create AI-enhanced images using our creative templates
  • Store memories with unlimited cloud storage
  • Track growth milestones and create timelines
  • Invite family members to view and interact with shared content

Privacy First: All content shared on Coocoo is private by default. Only users you explicitly invite can access your family's photos and memories.

4. User Content & Ownership

Your Content, Your Rights

You retain full ownership of all photos, videos, and content you upload to Coocoo. We do not claim any ownership rights over your content. Your memories belong to you.

License to Provide Service

By uploading content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you and your invited family members. This license ends when you delete your content or account.

Content Guidelines

You agree not to upload content that:

  • Violates any laws or regulations
  • Infringes on intellectual property rights of others
  • Contains inappropriate or harmful material
  • Exploits or endangers minors in any way
  • Contains malware, viruses, or harmful code

5. AI-Powered Features

Coocoo offers AI-powered features to transform and enhance your photos. By using these features:

  • You consent to your photos being processed by our AI systems to generate enhanced images.
  • AI-generated images are created for your personal, non-commercial use within the app.
  • We do not use your photos to train our AI models without explicit consent.
  • AI processing is performed securely, and original photos are not shared with third parties.

Important: AI-generated images are for entertainment and personal use. Results may vary, and we do not guarantee specific outcomes from AI processing.

6. Subscriptions & Payments

Free & Premium Tiers

Coocoo offers both free and premium subscription tiers. Premium features may include additional AI templates, increased storage, and advanced features.

Billing

  • Subscriptions are billed through the Apple App Store or Google Play Store.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
  • Refunds are handled according to the respective app store's refund policies.

Cancellation

You may cancel your subscription at any time through your app store account settings. Upon cancellation, you will retain access to premium features until the end of your current billing period.

7. Privacy & Data Security

Your privacy is fundamental to our Service. Please review our Privacy Policy for detailed information about how we collect, use, and protect your data.

8. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Upload or share content that exploits, harms, or endangers children
  • Attempt to gain unauthorized access to our systems
  • Use the Service for commercial purposes without authorization
  • Reverse engineer, decompile, or disassemble the app
  • Use automated systems or bots to access the Service
  • Harass, abuse, or harm other users
  • Spread malware or engage in phishing activities

9. Termination

By You

You may terminate your account at any time by deleting your account through the app settings. Upon termination, your data will be permanently deleted in accordance with our data retention policies.

By Us

We reserve the right to suspend or terminate your account if you violate these Terms, engage in prohibited activities, or if required by law. We will provide notice when possible and appropriate.

10. Disclaimers & Limitations

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or via email. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
